Chapter 40A, Article 4. Just Compensation

A recent discussion with a mortgagee, was a reminder that CarolinaCondemnationLaw.com needed to put up a page about Article 4 of Chapter 40A.  That article is entitled, “Just Compensation”.  It sets out the general rule for just compensation in eminent domain in NC for cases filed under Chapter 40A, including the greater-of rule for partial takings.  But in addition, Article 4 also sets out several key rules that are applicable generally to land condemnation in North Carolina, including the so-called scope of the project rule.  So, to read the complete text of Chapter 40A, Article 4, including the section that applies to trustees under deeds of trust and their beneficiaries as well as some brief comments about the article, you should click here.
